By creating an account or using The Pick, you agree to these terms. If you don’t agree, don’t use the platform.
The Pick is an event discovery platform. We connect buyers with second-hand sales — estate sales, auctions, flea markets, garage sales, and more. We are not a party to any transaction between buyers and sellers. We do not own, inspect, or guarantee any items at any listed sale.
You must provide a valid email address to create an account. You are responsible for all activity under your account. One account per person — creating multiple accounts to circumvent any restrictions is grounds for termination. You must be 18 or older to use The Pick.
Sellers are responsible for the accuracy of their listings. Misrepresenting sale type, location, dates, or inventory is a violation of these terms and may result in account suspension. By posting a listing, you grant The Pick a limited license to display and promote your listing content on the platform.
Company sellers who provide false information during account setup — including vendor counts for flea market and swap meet plans — are subject to back-billing at the correct tier and account suspension.
The Pick provides information about sales but cannot guarantee that any sale will proceed as listed. Sales can be cancelled, dates can change, and inventory is subject to availability. The Pick is not responsible for wasted trips.
You may not use The Pick to post fraudulent listings, scrape the platform, spam other users, or circumvent any access controls. Automated access to the platform without written permission is prohibited.
The Pick uses AI to generate listing suggestions, match recommendations, and buyer profile insights. AI outputs are suggestions only — sellers and buyers are responsible for reviewing and verifying AI-generated content before relying on it.
All payments are processed by Stripe. Subscriptions renew automatically until cancelled. Refunds for subscription charges are not issued once a billing period has begun. One-time purchases (elevations, photo unlocks) are non-refundable.
We may suspend or terminate accounts that violate these terms, misuse the platform, or engage in conduct that harms other users. We’ll make reasonable efforts to notify you, but reserve the right to act immediately in cases of fraud or abuse.
The Pick is provided as-is. To the maximum extent permitted by law, The Pick is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim is limited to the amount you paid us in the 12 months prior to the claim.
We may update these terms. We’ll notify you by email for material changes. Continued use of The Pick after changes take effect constitutes acceptance.
